1. Interpretation and Definitions

Interpretation

Words with capitalized first letters have meanings defined in this section. These definitions apply whether the terms appear in singular or plural form.

Definitions

  • Account – The unique profile created by you to access the Service.

  • Company, We, Us, Our – Refers to Hydra Hub, LLC.

  • Country – State of Colorado, United States.

  • Device – Any device capable of accessing the Service, such as a computer, smartphone, or tablet.

  • Feedback – Any suggestions, comments, ideas, or improvements you voluntarily provide.

  • Goods – Any products or items offered for sale through the Service (may not apply to all plans).

  • Orders – Your request to purchase Goods or access paid services.

  • Promotions – Contests, sweepstakes, or promotional activities offered through the Service.

  • Service – The Hydra Hub platform, website, systems, AI tools, messaging capabilities, and all related features.

  • Terms – These Terms & Conditions.

  • Third-Party Service – Any external service, software, integration, or platform that interacts with Hydra Hub.

  • You – The individual or entity using the Service.

2. Acknowledgment

These Terms are the agreement between you and Hydra Hub, LLC regarding the use of the Service. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must stop using the Service immediately.

You represent that you are at least 18 years old. Hydra Hub is not intended for minors.

Your use of the Service is also governed by our Privacy Policy, which explains how your information is collected, used, and protected. Please review it carefully before using the Service.

3. Use of the Service

You’re responsible for how your Account is used, including all automations, communications, uploads, AI-generated content, and actions triggered under your credentials.

Hydra Hub provides powerful tools—automation, messaging, AI assistance, and CRM functionality—but you control how they are used. You are solely responsible for:

  • The messages, emails, SMS, and AI outputs you generate or send

  • Having permission to contact your leads or customers

  • Complying with marketing, privacy, and communication laws

  • Maintaining accurate, lawful, and non-misleading content

Hydra Hub does not guarantee business results, conversions, bookings, revenue, or performance outcomes. AI responses may contain inaccuracies or omissions; important communications should be reviewed before sending.

Hydra Hub may limit or suspend your access if your usage:

  • Harms system performance or stability

  • Violates carrier or compliance rules

  • Creates excessive complaint rates or spam reports

  • Poses legal or security risk to the platform or its users

4. Accounts and Security

When creating an Account, you agree to provide accurate, complete, and current information. Failure to do so may result in suspension or termination.

You are responsible for safeguarding your password and Account access. Notify us immediately if you believe your Account has been compromised.

You may not use:

  • Another person’s or entity’s name without permission

  • Any username that is offensive, deceptive, or violates another’s rights

5. Subscriptions, Billing & Payments

5.1 Subscription Plans

Hydra Hub offers recurring subscription plans (monthly or annual) for access to the Service. By subscribing, you authorize recurring charges to your payment method until canceled.

5.2 Usage-Based Fees

Certain Service features include additional usage-based costs, such as:

  • SMS and A2P 10DLC messaging

  • Email sends

  • Phone number usage

  • AI processing or generation

  • Validation services (email/phone)

Usage fees may fluctuate based on provider costs from LeadConnector, Twilio, and other partners. You are responsible for monitoring usage from within your Account.

5.3 Payment Processing

Payments are handled through Stripe or GoHighLevel’s integrated billing system. By using the Service, you authorize Hydra Hub to process all applicable subscription and usage charges through these processors.

If a payment method fails or is declined, we may suspend or restrict access to the Service until payment issues are resolved.

6. Refund Policy

Hydra Hub does not offer refunds for subscription fees, usage charges, or add-on purchases.

Refunds are issued only in cases of:

  • Clear billing errors

  • Duplicate charges

  • Systemic malfunctions preventing service use (as verified by our team)

All other fees are final.

7. Cancellation Policy

You may cancel your subscription at any time from within your Account.

  • Cancellation takes effect at the end of the current billing cycle.

  • No refunds or prorated refunds are provided for partial months.

  • Usage fees incurred prior to the end of the cycle will still be billed.

After cancellation, your access will continue until the end of the paid period unless otherwise specified.

8. SMS Messaging & Consent

Hydra Hub and/or our customers may use the Service to send SMS or text messages, including:

  • Appointment confirmations and reminders

  • Account or service notifications

  • Product or service information

  • Webchat or form follow-up messages

  • Marketing messages where you have provided appropriate consent

By providing your mobile number and opting in to receive SMS, you agree to receive such messages. Message frequency may vary.

  • You can opt out of SMS at any time by replying STOP.

  • For help, reply HELP or contact us at [email protected].

  • Message and data rates may apply, depending on your carrier and plan.

  • Carriers are not liable for delayed or undelivered messages.

Mobile numbers and SMS opt-in data are not sold and are not shared with third parties or affiliates for their own marketing or promotional purposes. Any sharing with third-party providers (such as messaging gateways or carriers) is solely to deliver messages and maintain the Service.

9. Acceptable Use & Messaging Compliance

Hydra Hub allows you to conduct both warm and, where legally permitted, cold outreach, provided all usage complies with applicable laws and carrier rules, including but not limited to:

  • A2P 10DLC regulations

  • TCPA (Telephone Consumer Protection Act)

  • CAN-SPAM Act

  • Privacy and consent laws

  • Carrier messaging policies

You may not use the Service to engage in:

  • Illegal activity

  • Harassment, threats, or abusive behavior

  • Pornographic or explicit content

  • Deceptive, fraudulent, or harmful practices

  • High-risk financial schemes

  • AI misuse such as impersonation, deepfake identity creation, or deceptive messaging

Cold outreach is allowed only when messaging practices remain compliant, and do not cause excessive spam complaints, carrier violations, or deliverability issues.

Hydra Hub may suspend or restrict access to protect platform deliverability, carrier standing, or legal compliance. You are fully responsible for any penalties, blocked traffic, or enforcement actions by carriers or third-party providers resulting from your usage.

10. AI Tools and Limitations

Hydra Hub provides AI tools to streamline messaging, workflow creation, and communication. By using these tools, you acknowledge that:

  • AI outputs may contain errors or inaccuracies

  • AI does not replace human oversight or judgment

  • You are responsible for reviewing messages and content before sending

  • You must not use AI to impersonate real individuals or deceive consumers

  • You accept all liability arising from AI-driven communications

Hydra Hub does not guarantee results, performance, or accuracy of AI-generated content.

11. Data Handling and Privacy

Hydra Hub processes customer data strictly to provide and improve the Service. This may include:

  • CRM contact information

  • SMS and email activity

  • Chatbot conversations

  • Uploaded files

  • Workflow and automation data

You retain ownership of all data you upload, store, or process within the platform.

Hydra Hub does not sell your data. We do not share your data with third parties except as required to operate core services (e.g., Twilio, LeadConnector, email/SMS providers, hosting providers, payment processors) or to comply with law.

You are responsible for ensuring that your data collection and messaging practices comply with privacy and consent laws in your jurisdiction.

12. Promotions

Any Promotions offered through the Service may be governed by additional rules. If Promotion rules conflict with these Terms, the Promotion rules will apply for that specific Promotion.

13. Intellectual Property

All original content, features, software, and materials provided by Hydra Hub are owned by Hydra Hub, LLC and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, reverse engineer, distribute, or commercially exploit any part of the Service without express written permission.

14. Service Availability and Modifications

Hydra Hub may modify, suspend, or discontinue parts of the Service at any time to maintain performance, security, or compliance.

We may update these Terms at any time. If material changes are made, we will provide reasonable notice. Continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

15. Termination

Hydra Hub may suspend or terminate your Account immediately, with or without notice, if you:

  • Violate these Terms

  • Engage in unlawful or harmful activity

  • Abuse messaging systems

  • Cause carrier-level violations or deliverability issues

  • Fail to pay subscription or usage fees

Upon termination, your right to use the Service ends immediately.

You may cancel your Account at any time via your Account settings or by contacting us.

16. Limitation of Liability

To the maximum extent permitted by law, Hydra Hub and its providers will not be liable for:

  • Lost profits or revenue

  • Loss of data

  • Business interruption

  • Indirect, incidental, special, consequential, or punitive damages

  • Carrier blocking, spam filtering, or deliverability issues

  • AI outputs or errors

  • Compliance violations arising from your usage

In any case, Hydra Hub’s total liability for any claim arising out of or relating to the Service will not exceed the greater of:

  • $100 USD, or

  • The total amount paid by you to Hydra Hub in the 12 months prior to the event giving rise to the claim.

17. “As Is” Disclaimer

The Service is provided to you “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, statutory, or otherwise.

To the maximum extent permitted under applicable law, Hydra Hub disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as any warranties arising out of course of dealing or usage of trade.

Without limiting the above, Hydra Hub does not warrant that:

  • The Service will meet your requirements or expectations

  • The Service will be uninterrupted, timely, secure, or error-free

  • Any defects or errors will be corrected

  • Information obtained through the Service will be accurate or reliable

18. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law provisions.

19. Dispute Resolution

Before pursuing formal legal action, you agree to attempt to resolve any dispute informally by contacting us at [email protected].

If informal resolution is unsuccessful, disputes shall be handled in the state or federal courts located in Colorado, unless otherwise required by applicable law.

20. Severability & Waiver

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

The failure of Hydra Hub to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

21. Changes to These Terms

We may update or modify these Terms from time to time. When we do, we will update the “Last Updated” date at the top.

If we make material changes, we will take reasonable steps to notify you (for example, via email or in-app notice). Your continued use of the Service after changes become effective means you accept the updated Terms.
